La preeminencia de la ley en el sistema de fuentes español ha resultado matizada, como consecuencia de su interacción con el de la Unión. En lo que al control judicial se refiere, la matización se ha traducido en las facultades de inaplicación por el juez ordinario de la ley contraria al Derecho de la Unión. Pero lo anterior no hace desaparecer la naturaleza de la ley en cuanto elemento clave del sistema democrático, lo que exige mantener, al máximo posible, el sometimiento del juez ordinario a los mecanismos de control establecidos, tanto más si el resultado de dicho control conduce a la inaplicación de aquélla. Es imprescindible el uso con el máximo rigor de la vía indirecta de control de la ley que proporciona la cuestión prejudicial de interpretación cuando tal planteamiento sea obligatorio. La vulneración de tal obligación por parte del juez conlleva la vulneración de la tutela judicial efectiva.</p> <p align="justify"><strong>The article sets out the relationship between EC preliminary ruling and the right to effective judicial protection based on the jurisprudence of the Spanish Constitutional Court. The pre-eminence of Parliament Acts in the Spanish system of sources has been qualified as a consequence of its interaction with that of the Union. In regard to judicial control, this qualification has translated into the powers of disapplication by an ordinary judge of Parliament Acts contrary to Union Law. But the above does not remove the nature of Parliament Acts insofar as it is a key element of the democratic system, something that demands the utmost subjection of an ordinary judge to the established control mechanisms, all the more so if the result of said control leads to the disapplication of such ACTS. Maximum rigour is indispensable in the use of the means of indirect judicial control provided by preliminary ruling on interpretation when such an approach is obligatory.
