El presente trabajo estudia la forma en que una Entidad Local pueda prestar un servicio público de su competencia de forma conjunta o cooperativa con otras administraciones públicas. En concreto, se analiza el artículo 12.4 de la Directiva 2014/24/UE, sobre los contratos para la prestación conjunta de servicios públicos. Se estudian su fundamento y las condiciones que deben cumplirse para su válida utilización, en tanto que se trata de una excepción a la normativa sobre contratos públicos. La conclusión es que el Derecho Europeo admite y regula una forma tradicional de gestionar servicios públicos locales.
This paper studies the way a Local authority can provide a public service of its competence jointly or cooperatively with other public authorities. Specifically, article 12.4 of Directive 2014/24 /EU, on “contracts for the joint provision of public services”, is analyzed. Its basis and the conditions that must be fulfilled for its valid use are studied, as it is an exception to the rules on public works contracts. The conclusion is that European law supports and regulates a traditional way of managing local public services.
