The consortia of the autonomous public sector: nature and characteristics

Abstract

The figure of the interadministrative consortium, born from the hand of the regulations of the local regime, has made a great evolutionary leap to be among public entities most emergent instruments of the autonomous public sector. However, the growing presence of the consortiums in the autonomous community has not meant an update of its legal regime, with a majority of the Autonomous Communities that have not yet proceeded with the regulatory regulation of this figure. In the present article the analysis is approached of the normative evolution of this typology of public entity advancing, in view of the disparity of criteria contained in the comparative autonomic regulations, a proposal of basic regulation that harmonizes the rules of secondment of the consortiums to the public sector in question, in order to duly clarify the legal regime to which they must be submitted in the development of its activities and its operation.
